FORTHCOMING APPLICATION

1. Application on 7.75 acres located on Lawrenceville Hwy. next to old Pikes Nursery by Summerall Development. 6.54 acr. of RA-8, to include 31 attach. homes & 20 detach. homes and 1.21 acr. of C-2. This information is courtesy of Laura David, attorney for Summerall. A preapplication meeting of the neighborhood will be held. This will probably be on the County's September agenda. Former TCA PPLUZ Chair has has requested that Summerall reduce the C-2 zoning to a less intensive C-1 and there is some feeling that O-I would be preferred.

RECENT APPLICATIONS

1 . Deferred LP-07-12654 & Z-07-12661. Summerall Development Corp. to amend Land Use from LDR to MDR and rezone from R-75 to RM-75 on 2.29 acres(3 lots) of property located on Cooledge Rd, near Lawrenceville Hwy, behind the Jiffy Lube and across the street from the QuickTrip. Original application was to build 24 condos and then lowered to 21. Neighborhood wants the density lowered to Land Use of LMR, Zoning of RA-8 and build 18 condos. On July 2, 2007, the Applicant had a meeting with 20+ people from the neighborhood and announced he would agree to a Land Use of LMR & Zoning of RA-8 to build 18 units but that the units would have to be three(3) stories & a larger, higher quality product in order for the finances to work for him. If the neighborhood did not agree then he would request to "withdraw without prejudice". Discussion followed. Site plan was to be available in 24 hrs. On July 3rd, a meeting was held by Comm. Elaine Boyer with Andrew Baker (Planning Dept), Jean Brown & Jackie Dial (neighborhood & Community Council 1, Miriam Gardner & Bruce Penn (TCA & Community Council 1), and developers Summerall (Cooledge Rd.) and Ventura (Hebron Hills). The agenda was to discuss the Summerall application on Cooledge Rd and the Ventura application on Hebron Hills. It seemed that Summerall would likely file for Withdrawal after listening to Jean Brown's report of the July 2nd meeting. The Planning Commission met on July 5th, took no action and voted to Defer the application to the Board of Commissioners. TCA's original position was to support the neighborhood in a Land Use of LMR & Zoning of RA-8. We now support the anticipated request to "Withdraw without prejudice."

2. LP-07-13323 LIC, POS to LMR & Z-07-13322 C-1 & R-85 to RA-8. Application to build 61 condos on 8+ acres of land, Lawrenceville Hwy behind the Green Egg (formerly the Hebron Hills Swim Club). The abutting neighborhood has some concerns re. buffers & set backs, height of condos, protection of the creek, and lower density referencing gross acreage vs developable acreage. The Community Council, June 19th, recommended "Deny". At Comm. Boyer's July 3rd meeting, the following was requested: a landscaping plan and a location for overflow parking. On July 5th, the Planning Commission recommended Approval of Ventura's amended Land Use Map and approval of the Rezoning application subject to conditions agreed upon between the neighborhood and the developer. On July 8th, the TCA Board voted to support approval contingent upon agreement between the neighborhood and developer re: conditions.

COMPLETED APPLICATIONS

5. Application to rezone 1.96 acres located on Chamblee Tucker Rd./ Smithsonia Dr. from R-85 to R-60 (Z- 07-6788.). The applicant proposed building 10 single family detached homes. The TCA Board of Directors position was to recommend "Defer full cycle." Ultimately, the applicant requested to "Withdraw without Prejudice". This request was approved by the Planning Commission on May 8th and the Board of Commissioners on May 22nd.

4. LP-07-12842 & Z-07-12846, Peter & Grace Han to amend Land Use from LDR to OPR and rezone from R-75 to O-I on 0.5 acres of property located at 5149 LaVista Rd. This is the property TCA has been involved with since 2002 and submitted conditions for in 2005. Application was "Approved with Conditions" by Board of Commissioners on March 27, 2007. TCA supported this application.

MISCELLANEOUS

1. Mainstreet Tucker Alliance's LCI application for approval to obtain more grant monies. The Commnity Council's recommendation on June 19th was to Defer. The Planning Commission recommended Approval on July 5th. TCA Board voted to support MTA's application in writing and by authorizing Bruce Penn, PPLUZ Chair, to speak in support at the Board of Commissioners meeting on July 24.

2. The Dekalb County Comprehensive Land Use Plan was approved on May 22, 2007 by the Board
of Commissioners. The DeKalb County Planning Department and hired consultant will now work on the Zoning plan. Public meetings will be announced in the future.
